Terms and Conditions of Sale

yasakatabletennis.com
Consumer purchases within the European Union

1. General

These Terms and Conditions apply to purchases made through www.yasakatabletennis.com by consumers residing in the European Union. The website is operated by WoodHouse i Tranås AB, Sweden. Our contact details are provided in Section 9. These terms do not apply to purchases made for business purposes.

You must be at least 18 years old to place an order, unless a parent or legal guardian has approved the purchase and the purchase is permitted under applicable law. You must provide a valid email address.

A purchase contract is formed when we send an order confirmation to the email address you provided. If we cannot accept an order, we will inform you and refund any payment received for that order.

These terms do not limit any mandatory consumer rights under applicable EU or national consumer protection law.

2. Orders and Product Information

Orders are placed through our website. Please check your order details, delivery address and selected products before submitting your order.

If a product is unavailable or a problem arises with your order, we will contact you as soon as reasonably possible by email or telephone. If we cannot fulfil the order, any amount paid for the unfulfilled order will be refunded.

We take reasonable care to ensure that prices and product descriptions are accurate. If there is an obvious error, we will contact you before processing the order further. We will not change an agreed price unilaterally after a binding contract has been formed.

3. Prices and Payment

Prices are displayed in the currency indicated on the website and include applicable VAT. Delivery charges and any other applicable charges payable to us will be displayed before you place your order.

Prices for future orders may change without prior notice. The price applicable to your order is the price agreed when the contract is formed, subject to the handling of an obvious error as described in Section 2.

Payment can be made using the payment methods offered at checkout. Available payment methods may vary depending on your country. Any terms applicable to your selected payment method will be presented before you complete your purchase.

Refunds will be made using the same payment method as the original transaction, unless you expressly agree otherwise. You will not incur any fees from us as a result of the refund.

4. Delivery

Available delivery countries, shipping methods, delivery charges and estimated delivery times are shown on the website or at checkout. Delivery is available to the destinations offered at checkout.

Delivery times may vary depending on the destination and the products ordered. Clothing printed or customised to your specifications may require additional production time. Any applicable production time will be communicated before you place your order.

Unless another delivery period has been agreed, we will deliver your goods without undue delay and no later than 30 days after the contract is formed.

If we fail to deliver within the agreed period, you may require us to deliver within an additional reasonable period. If we do not deliver within that period, you may cancel the purchase and receive a refund. You may cancel without allowing additional time where applicable law permits, including where we refuse to deliver or delivery by a particular date was essential in the circumstances specified by law.

The risk of loss or damage passes to you when you, or a person designated by you other than the carrier, physically receive the goods. If you independently appoint a carrier that we did not offer, the applicable statutory rules on transfer of risk apply.

If a parcel is not collected, we may seek compensation for reasonable, documented costs caused by the failure to collect it, where permitted by law and provided the applicable terms were clearly disclosed before purchase. Any fee must not operate as an unlawful penalty or restrict statutory rights. Contact us if you are unable to collect a parcel.

Failure to collect a parcel does not, by itself, constitute notice that you wish to exercise your right of withdrawal. If you wish to withdraw from your purchase, please notify us as described in Section 5.

5. Right of Withdrawal and Returns

As a consumer, you generally have the right to withdraw from your purchase within 14 days without giving a reason, subject to statutory exceptions.

The withdrawal period expires 14 days after the day on which you, or a person designated by you other than the carrier, receive the goods. If goods from a single order are delivered separately, the period generally runs from receipt of the last item.

To exercise your right of withdrawal, notify us of your decision before the withdrawal period expires by emailing customer@woodhouse.se or by sending another clear statement to the contact address in Section 9. You may use the model withdrawal form below, but this is not mandatory.

You may also exercise your right of withdrawal using the online withdrawal function on our website. When you use this function, we will send you an acknowledgement of receipt on a durable medium, such as email, without undue delay.

You must send the goods back without undue delay and no later than 14 days after notifying us of your withdrawal. The deadline is met if you send the goods before that period expires. Contact us for return instructions; prior approval is not required to exercise your statutory right of withdrawal.

You are responsible for the direct cost of returning the goods, provided you were informed of this before purchase. If goods cannot normally be returned by post, the applicable return cost or a reasonable estimate will be provided before purchase.

You may inspect the goods to establish their nature, characteristics and functioning. You are only liable for any diminished value resulting from handling beyond what is necessary for that purpose, and only where we have provided the legally required information about your right of withdrawal.

The right of withdrawal does not apply to goods made to your specifications or clearly personalised, where the statutory exception applies. This may include clothing printed to your individual requirements. The exception does not automatically apply to every printed item or every product made after an order is placed.

If you withdraw from the entire purchase, we will reimburse all payments received from you, including the cost of our least expensive standard delivery option. We are not required to reimburse additional delivery costs resulting from your choice of a more expensive delivery method.

Reimbursement will be made without undue delay and no later than 14 days after we are informed of your decision to withdraw. We may withhold reimbursement until we have received the goods or you have supplied evidence of having sent them back, whichever occurs first, unless we have offered to collect the goods.

If a product is faulty or incorrectly supplied, the complaint rules in Section 6 apply instead. Your statutory remedies for faulty goods are separate from your right of withdrawal.

6. Complaints and Faulty Products

You have statutory rights if goods are faulty or do not conform to the contract. EU rules provide a minimum two-year legal guarantee of conformity. This is a statutory right, not an optional commercial warranty. Applicable national law may provide longer protection or additional rights.

Under Swedish law, the statutory period for complaints about goods is generally three years from delivery. A complaint made within two months of discovering the defect is always considered to have been made within a reasonable time. Any stronger mandatory rights applicable to your purchase remain unaffected.

Depending on the circumstances and applicable law, you may be entitled to repair, replacement, a price reduction, cancellation and/or damages. Repair or replacement must be provided free of charge, within a reasonable time and without significant inconvenience. A price reduction or cancellation is available where the applicable legal conditions are met.

To make a complaint, email customer@woodhouse.se and describe the problem. Please include your order number and, where possible, photographs to help us assess the issue. These requests do not limit your statutory rights.

If your complaint is justified, we will provide the remedy required by applicable law and cover necessary return costs. Please contact us before returning faulty goods so that we can arrange an appropriate return method.

7. Personal Data

We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable data protection legislation. Please read the Privacy Policy published on our website for information about how we collect, use and protect personal data and how you can exercise your rights.

8. Applicable Law and Disputes

These Terms and Conditions are governed by Swedish law. Where we direct our commercial activities to your country of habitual residence and your purchase falls within those activities, this choice of law does not deprive you of the protection of mandatory consumer law provisions in that country.

If you have a complaint or a dispute, please contact us first so that we can try to resolve it together.

You may refer an eligible dispute to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), www.arn.se, Box 174, 101 23 Stockholm, Sweden. We will follow ARN recommendations where applicable.

For assistance with a cross-border consumer dispute, you may contact the European Consumer Centre in your country of residence through ECC-Net.

Disputes may also be brought before a competent court under the applicable jurisdiction rules. These terms do not restrict any right you have under mandatory law to bring proceedings in your country of residence.
